Terms of Service
Effective 21 July 2026. Applies to the Luno Android application
(com.luno.gateway), published by Nex NeoTech.
Luno sends real SMS from your SIM, at your expense, under your phone number. You are responsible for every message it sends and for complying with the law and your carrier’s terms wherever you operate it.
1. What you are agreeing to
Luno is free, open-source software licensed under Apache-2.0 . Installing or using the app means you accept these terms and that licence. Where the two differ on the software itself, the Apache-2.0 licence governs.
2. There is no service
Nex NeoTech provides an application, not a service. We operate no servers the app connects to, hold no account for you, and process no messages.
Luno only works once you point it at a backend you provide and control. Availability, reliability, retention and security of that backend are entirely your responsibility. Nothing here creates any uptime commitment or support obligation on our part.
3. Your responsibilities
By running Luno you agree that you:
- Own or are authorised to use the device and SIM it runs on, and will pay any message, data or roaming charges it incurs;
- Will comply with all applicable law, including anti-spam and electronic marketing rules, telecommunications regulation, and data-protection law in every jurisdiction you send to or from;
- Will obtain any consent required from the people you message;
- Will honour your carrier’s terms, including restrictions on automated, bulk or commercial messaging over a consumer plan;
- Will secure your own deployment — the backend, the pairing credentials and physical access to the device.
4. Prohibited use
You must not use Luno to send unsolicited bulk messages or spam; to impersonate another person or organisation; to commit fraud, phishing or social engineering; to send one-time passcodes or verification messages on behalf of a service you are not authorised to act for; to harass or threaten; to bypass a carrier’s messaging restrictions or fraud controls; or for anything unlawful where you operate.
Luno is a gateway for messages you are entitled to send. It is not a bulk marketing platform, and we do not support that use.
5. Your data and messages
We never receive them. See the Privacy Policy. Where you process other people’s personal data through a Luno node, you act as the data controller and carry the corresponding obligations.
6. No warranty
The software is provided “as is”, without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, as set out in the Apache-2.0 licence.
Specifically, and without limiting that: SMS delivery is not guaranteed. Delivery depends on carriers, network conditions, SIM state, device power management and manufacturer battery restrictions, none of which the app controls. Do not rely on Luno as the sole channel for safety-critical, emergency, medical or financial messaging.
7. Limitation of liability
To the maximum extent permitted by law, Nex NeoTech and the project’s contributors are not liable for any indirect, incidental, special, consequential or exemplary damages, nor for lost profits, lost data, undelivered or misdelivered messages, carrier charges, or business interruption, arising from your use of Luno — even if advised of the possibility.
8. Third-party services
Distribution through Google Play is additionally subject to Google’s terms. Your carrier’s terms govern the messages themselves. We are not party to either.
9. Changes
These terms may be revised; the current version is always at this URL with its effective date. Continued use after a change means acceptance. Past versions are recoverable from the repository’s git history.
